Sandhills Functional Medicine, PLLC ("SFM," "we," "us," or "our") is a HIPAA covered entity located at 334 Mill Creek Rd, Suite B, Carthage, North Carolina 28327. This policy describes how we use SMS/MMS text messaging, email, and telephone voicemail to communicate with patients and prospective patients, what information those channels may contain, how we protect it, and how you control it.
This policy supplements — and does not replace — our Notice of Privacy Practices (NPP), which describes all of the ways we may use and disclose your PHI under the Health Insurance Portability and Accountability Act of 1996 and its implementing regulations at 45 C.F.R. Parts 160 and 164 ("HIPAA"), and our Website Privacy Policy. If this policy conflicts with the NPP regarding PHI, the NPP controls.
Our patient communications are sent through our electronic health record and patient-engagement platform, Decoda Health, which has signed a HIPAA Business Associate Agreement with SFM, and through the telecommunications carriers required to deliver messages to your device.
Text (SMS/MMS)
Appointment confirmations, reminders, and rescheduling; check-in and intake links; secure-portal notifications ("You have a new message / result in your portal"); balance and payment reminders; brief care-coordination messages (e.g., "Please fast before tomorrow's draw"); two-way replies to questions you text us; practice updates if you separately opt in.Lab values, diagnoses, full medication lists, imaging, or other detailed clinical content; anything about mental health, substance use, HIV status, genetic results, or reproductive health unless you specifically request it in writing.
Appointment and billing notices; receipts; welcome and onboarding information; secure-portal notifications; educational content and practice news if you opt in; direct replies to your emails.Detailed clinical information (sent via the secure portal instead); attachments containing PHI unless you have requested and acknowledged the risk in writing.
Voicemail
Our name, a callback number, and the general reason for the call ("calling to confirm your appointment," "please call us regarding your results," "calling about your account").Specific results, diagnoses, treatment details, or financial specifics — we ask you to call back or check your portal. We leave PHI in voicemail only if you have asked us to in writing.
We follow HIPAA's minimum-necessary standard: each message contains only the information needed for its purpose. If you have asked us to contact you only at a specific number or address, or not to leave voicemails, we honor that request (see Section 6).
You opt in to text messages by one of the following: checking the text-message consent box on our intake or website form, providing your mobile number to our staff and verbally agreeing to receive texts (documented in your chart), or texting us first. When you opt in, you will receive a one-time confirmation text describing the program and how to opt out.

By providing my mobile number and checking this box, I agree to receive text messages from Sandhills Functional Medicine, PLLC at the number provided, including appointment reminders, scheduling, care-coordination, billing, and account messages. Message frequency varies. Message and data rates may apply. Reply STOP to cancel at any time or HELP for help. Consent is not a condition of purchase or of receiving care. I understand that text messages are not encrypted and may be viewed by anyone with access to my phone. Marketing texts (promotions, new services, events) require a separate, clearly labeled opt-in and are never bundled with treatment or appointment messages. You can stop marketing texts while continuing to receive appointment reminders.
By providing your email address on an intake, website, or scheduling form you consent to receive transactional and care-related email. Marketing and educational email requires a separate opt-in, and every such email includes an unsubscribe link.
By providing a telephone number you consent to us calling and, if you do not answer, leaving a limited voicemail as described in Section 3. If you do not want voicemails left, or want them left only at a specific number, tell us and we will note it in your chart.
Standard SMS and email travel over networks we do not control, can be misdirected if a number or address changes, and can be read by anyone with access to your device or account. By opting in, you acknowledge these risks and choose these channels anyway. You may switch to portal-only communication at any time.

Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message. Reply HELP for assistance or call (910) 621-7410.You receive one final confirmation text and no further texts. Opt-out takes effect immediately. To restart, reply START or ask staff.
Click "unsubscribe" in any marketing email, or call or write us to stop all non-essential email.Marketing stops within 10 business days. Transactional notices (receipts, appointment confirmations) continue unless you ask us to stop those too.
Voicemail
Call (910) 621-7410 or tell any staff member; we will document your preference.We will call and hang up without leaving a message, or leave a message only at the number you designate.
Opting out of any channel never affects your care or your access to the secure patient portal. If you opt out of all reminder channels we may be unable to remind you of appointments; you remain responsible for keeping them.
Requests may be made in person, by phone, by portal message, or in writing to the Privacy Officer at the address in Section 11.
Your mobile number, email address, message content, and opt-in/opt-out status are used only to deliver the communications described in this policy and to maintain required consent records. We share them only with:
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be shared with any third parties. We do not sell contact information or message content.
If a message containing PHI is sent to the wrong number or address, or a messaging system is compromised, we follow the HIPAA Breach Notification Rule (45 C.F.R. §§164.400–414) and the North Carolina Identity Theft Protection Act (N.C. Gen. Stat. §75-65). Depending on the risk assessment, this may include notifying you without unreasonable delay and no later than 60 days after discovery, notifying the U.S. Department of Health and Human Services, and notifying the North Carolina Attorney General.
If you receive a message from us that was not intended for you, please do not forward it; reply or call (910) 621-7410 so we can correct our records, then delete it.

You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights, at hhs.gov/ocr/complaints or 1-800-368-1019, or with the North Carolina Medical Board. We will never retaliate against you for filing a complaint.
We may revise this policy as law, carrier requirements, or our systems change. The effective date at the top of this page will be updated, the current version will always be posted at this address, and material changes will be communicated through the channels you have consented to.
